A divorce judgment issued in Switzerland is not automatically recorded in the Turkish civil registry. For the divorce to produce legal effects in Türkiye, the appropriate procedure must be completed. Depending on the circumstances, this may involve administrative registration or judicial recognition and, where necessary, enforcement before a Turkish court.

Administrative registration

If the sole purpose is to update the Turkish civil registry following a final divorce in Switzerland, it may be possible to complete the process without commencing court proceedings.

The application can be submitted to the competent civil registration authority in Türkiye or, where the relevant conditions are satisfied, to a Turkish diplomatic or consular mission.

Former spouses may apply jointly. Separate applications completed within the period prescribed by Turkish law may also be accepted. Where one of the former spouses is a foreign national or has died, the Turkish party may, in principle, submit the application alone.

The principal documents generally include the final Swiss divorce judgment, evidence that the judgment has become final, the relevant apostille and a duly certified Turkish translation. Additional documentation may be requested depending on the parties’ nationality and the circumstances of the case.

When are recognition and enforcement proceedings required?

Administrative registration primarily updates the person’s marital status in the Turkish civil registry. It does not necessarily make every provision of the Swiss judgment enforceable in Türkiye.

Where the judgment contains orders concerning maintenance, compensation or another obligation requiring compulsory execution, an enforcement judgment may be necessary. Judicial recognition may also be required if administrative registration is unavailable or if an application has been refused.

A Turkish court does not rehear the divorce case or reassess whether the Swiss court reached the correct substantive outcome. Its examination is generally limited to matters such as the finality of the foreign judgment, compliance with the right to be heard and compatibility with Turkish public policy.

Recognition allows the Swiss divorce judgment to be accepted as legally binding in Türkiye. Enforcement enables enforceable obligations contained in that judgment to be executed through the Turkish legal system.

Is it necessary to travel to Türkiye?

In many cases, the procedure can be completed without the parties travelling to Türkiye. An application or court case may be handled by a lawyer in Türkiye on the basis of a properly executed special power of attorney.

The power of attorney should expressly cover the relevant registration, recognition or enforcement procedure. Missing apostilles, incomplete translations or insufficient proof of finality may delay the process.

Recognition of a Turkish divorce judgment in Switzerland

The same general issue may arise in the opposite direction. A divorce judgment issued in Türkiye is not automatically entered in the Swiss civil status registers.

Its recognition is assessed primarily under Article 65 of the Swiss Federal Act on Private International Law and the applicable general recognition requirements. The final Turkish judgment and the required supporting documents must be submitted to the competent Swiss authority before the civil status records can be updated.
